Terms and Conditions of the ONLINE TRADING PLATFORM
The Online Trading Platform at https://orders.timetoeat.me/apartamenty/sniadanie-2/ is operated by GAPLO LIMITED, 10625275, 192 Brettenham Road, London, United Kingdom, E17 5AY, email: kontakt@timetoeat.me, phone: +48 573 019 496 (standard operator charges apply), hereinafter referred to as the Operator or Provider of the Online Trading Platform.
For the purposes of these Terms and Conditions, the following terms shall have the following meanings: a) Terms and Conditions – these terms and conditions; b) Operator/Provider of the Online Trading Platform – GAPLO LIMITED, 10625275, 192 Brettenham Road, London, United Kingdom, E17 5AY, email: kontakt@timetoeat.me, phone: +48 573 019 496 (standard operator charges apply); c) Service/Online Trading Platform – the website located at the domain https://orders.timetoeat.me/apartamenty/sniadanie-2/; d) User – an individual using the Service provided electronically by the Service Provider; e) Service – all services provided electronically by the Operator to Users based on the rules specified in these Terms and Conditions, using software, including the Service’s website, enabling Users to conclude distance contracts via the Online Trading Platform; f) Provision of services electronically – the performance of a service provided without the simultaneous presence of the parties (remotely), through the transmission of data at the individual request of the User, sent and received using electronic processing devices, including digital compression, and data storage, which is entirely transmitted, received, or sent via a telecommunications network within the meaning of the applicable UK telecommunications regulations; g) Commercial Information – any information intended directly or indirectly to promote goods, services, or the image of an entrepreneur, excluding information enabling communication by electronic means with a specific person and information about goods and services not intended to achieve the commercial effect desired by the entity commissioning its dissemination, particularly without remuneration or other benefits from producers, sellers, or service providers; h) Account – a free function of the Online Trading Platform through which a User can create their individual account;
The Service is administered by the Operator. The Terms and Conditions are made available by the Operator free of charge, including at the User’s request, before concluding a contract for the provision of electronic services, in a manner that allows the acquisition, reproduction, and recording of the Terms and Conditions using the User’s ICT system. The Terms and Conditions set out the general rules for the operation of the Service, including the general rules for the provision of electronic services by the Operator. These Terms and Conditions are the terms referred to in the applicable UK regulations on the provision of electronic services. The Operator is a party to meal sales contracts. The Operator, running an online store on the Online Trading Platform, is responsible for fulfilling all obligations incumbent upon it as a seller arising from transactions concluded in the online store operated on the Online Trading Platform. With regard to contracts concluded by consumers using the Online Trading Platform, the Operator is liable under the rules specified in these Terms and Conditions for the services provided within the Service, as referred to in Section 5 of these Terms and Conditions. Within the Service, the Operator undertakes to provide Services within the scope and under the conditions specified in these Terms and Conditions. The Service is compatible with the following browsers: Microsoft Edge 99+, Safari 4+, Firefox 98+, Opera 9+, Chrome 90+. The Operator makes every effort to ensure the Service’s compatibility with other browsers; however, using them may result in incomplete functionality of some Service features. To ensure proper use of all Service functionalities, it is recommended to keep the browser updated. Some services provided within the Service require an email account. To fully and correctly use the Services, it is recommended to enable the browser’s support “cookies” handling in accordance with the rules set out in the Service’s Privacy Policy and Cookies Policy.
The User is obliged, in particular, to: a) use the Service in a way that does not disrupt its operation, particularly by using specific software or devices and refraining from any actions aimed at interfering with the Service’s software; b) refrain from actions such as sending or posting unsolicited Commercial Information or spam on the Service, posting content that violates applicable laws, good morals, or is otherwise unlawful, as well as advertising content, and undertaking IT activities or any other actions aimed at obtaining information not intended for the User; c) use the Service in accordance with the laws applicable in the United Kingdom, the provisions of these Terms and Conditions, and accepted customs in this regard; d) use the Service in a manner that is not burdensome for other Users or the Operator, respecting their personal rights (including the right to privacy) and all their rights; e) use all content posted within the Service solely for personal use – all content available on the Service constitutes works within the meaning of the Copyright, Designs and Patents Act 1988 and may not be used in any way other than using the Service’s services without the Operator’s consent. In particular, the User may not download photos and descriptions of individual meals presented on the Online Trading Platform and use them for purposes other than familiarizing themselves with the content available on the Service; f) notify the Operator of any infringement of their rights in connection with the use of the Service, as well as any violation of the rules set out in these Terms and Conditions; The Operator may deprive the User of the right to use the Service, as well as limit their access to part or all of the Service’s resources or Services offered within the Service, including deactivating their Account, with immediate effect, in the event of a violation of these Terms and Conditions by the User, particularly, but not exclusively, when the User: a) provided personal data that is untrue, inaccurate, or outdated, misleading, or infringing the rights of third parties; b) committed an infringement of third parties’ personal rights, particularly the personal rights of other Service Users, or engaged in behaviors constituting prohibited acts (misdemeanors or crimes) through the Service; c) engaged in other behaviors deemed by the Operator to be reprehensible, contrary to applicable laws, the provisions of these Terms and Conditions, or general principles of Internet use, contrary to the purposes of creating the Service, or damaging the Operator’s reputation; The Operator will notify the registered User of the deactivation of their Account by sending a message to the email address provided during registration. Users do not incur any fees to the Operator for obtaining and maintaining User status in the System. The use of contact methods specified in these Terms and Conditions does not entail any fees for the User to the Provider of the Online Trading Platform.
The User may register on the Service and create an account. Registration is voluntary and free of charge. During the registration process, the User completes a registration form available on the Service’s website. The form requires the User to provide the following data: a) the User’s first and last name; b) the User’s email address; c) the User’s delivery address and phone number; d) other data required by applicable laws; During registration, the User may select the following options regarding: a) acceptance of the Terms and Conditions along with the Service’s Privacy Policy and Cookies Policy; b) consent to receiving marketing and promotional information via the communication channel provided during registration (based on the consent given, the Provider of the Online Trading Platform is authorized to send information regarding meals offered by the Operator. The scope of consent may be broader than indicated above if specified in the information provided before giving consent. The Operator is solely responsible for receiving statements of consent withdrawal – contact details as in Section 1, paragraph 1 of these Terms and Conditions). Registration requires the User to accept the Service’s Terms and Conditions along with the Privacy Policy and Cookies Policy, without which the provision of Services by the Operator for registered Users will not be possible. Other consents are optional and do not constitute a necessary condition for registration on the Service or access to Services. The User may change their data provided during registration. Registration and creation of an Account by the User allow: a) the option to automatically fill in data during the process of concluding meal sales contracts with the Operator; b) access to order history; c) reordering based on an order from the history (provided all products included in it are still available in the offer). The User is obliged to keep their password to their individual Account associated with their login confidential. The User bears full responsibility for the consequences of sharing their Account access password with third parties. The User may at any time request the termination of the contract for the provision of electronic services (without observing a notice period), in particular by requesting deregistration from the Service (Account deactivation). Deregistration is done by sending an email with a deactivation request to the email address: kontakt@timetoeat.me. If the User requests the deletion of any personal data provided in the form necessary
